Calcutta High Court asks Mohammed Shami to pay Rs 4 lakh to Hasin Jahan and daughter as alimony
Jahan had moved the high court after a district sessions court in 2023 ordered Shami to pay Rs 50,000 to his wife and Rs 80,000 to their daughter. Justice Ajoy Kumar Mukherjee’s Tuesday order said, “I think Rs 1,50,000 to the petitioner no. 1 (wife) and Rs 2,50,000 to her daughter would be sufficient to support them till the main case is decided.
The order further said, “Regarding the petitioner’s child, the husband/opposite party no 2 is free to support her with educational or other common expenses in addition to the above amount.
In March 2018, Jahan lodged a complaint at Jadavpur police station against Shami and his family. This was four years after they got married in April 2014. She alleged great physical and mental torture under Section 12 of the Protection of Women from Domestic Violence Act, 2005 and continuous neglect of her minor daughter.
She also accused Shami of dowry harassment and match fixing and stopping financial support. She sought financial support including Rs 7 lakh per month for herself and extra Rs 3 lakh for her daughter. The magistrate initially rejected her prayer for financial support and ordered Shami to pay Rs 80,000 monthly for his daughter. Later the order was changed on appeal and Shami was asked to pay Rs 50,000 monthly to his wife and Rs 80,000 to his daughter.

The high court order said, “Based on the evidence and the factors for deciding maintenance, I think the interim financial support given by the lower court needs to be changed. It further added, “The husband’s income and financial records show he can pay more. The wife who is unmarried and living alone with the child deserves a level of support similar to what she was getting during the marriage which will protect her future and her child’s future.
